Dispute resolution and arbitration

Any disputes or claims arising out of or relating to these Terms, the Site, or any products or services purchased through the Site will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Arbitration shall be conducted in accordance with the rules of the American Arbitration
Association (AAA) and, unless otherwise agreed by the parties, shall take place remotely or in Boise, Idaho. The arbitrator’s decision will be binding and may be entered as a judgment in any court of competent jurisdiction.

To the fullest extent permitted by law, arbitration shall take place on an individual basis, and class arbitrations and class actions are not permitted. By agreeing to these Terms, you and Kate’s Real Food waive any rights to a jury trial or to participate in a class action.

If arbitration filing fees are required, we will reimburse reasonable filing fees for claims totaling less than $10,000, unless the arbitrator determines the claims are frivolous.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of Idaho, without regard to conflict-of-law principles.

Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and Kate’s Real Food regarding your use of the Site and supersede any prior agreements.

Changes to these Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
